From an Employment Standpoint, this so-called Bathroom Debate is Nothing New

Anyone who doubts the influence popular culture has on the workplace need look no further than the burgeoning debate on transgender bathroom use to be swayed.   Of course, transgender issues are not new.  Viewers of the Amazon Prime series Transparent are reminded of this every time the opening credits, featuring vintage footage from as much as 5 decades ago, play.  In fact, in 1975, the sitcom All in the Family introduced transgendered character Beverly LaSalle, who went on to appear in several more episodes.

The Quiet Change Made by the EEOC with a Big Impact

 Earlier this year, the Equal Employment Opportunity Commission (EEOC) made a quiet, procedural change which has a potentially huge impact on employers.  The EEOC, which is responsible for the enforcement of the Nation’s anti-discrimination laws, decreed that a Charging Party can request and receive an employer’s position statement and all supporting documents, while the investigation is still open.

Even before Caitlyn Jenner graced the cover of Vanity Fair, one question was the undisputed leader in terms of consistency.  Whether during a consulting phone call or a training seminar, someone always seems to ask: what happens if I hire John and he reports to work as Joanna?   

Even in 2016, there isn’t an app for that; however, what does exist is enough of a glance into the enforcement practice of the Equal Employment Opportunity Commission (EEOC) to at least provide practical guidance in addressing the most common concerns.
